Fence Policy
  1. Cranberry Estates is a planned community of homes in Perkiomen Township, which was organized pursuant to a recorded Declaration of Covenants, Conditions and Restrictions. There is also a set of Deed Restrictions applicable to the Property.

  2. Both the Declaration and Deed Restrictions contain provisions regarding the types of fence, which may be installed and maintained at Cranberry Estates. The Board has been advised, and agrees, that the documents provide that only wooden, post and rail, split rail fences may be installed and maintained at Cranberry Estates.

  3. The Board believes that (i) it was the intent of the Declarant, and (ii) in the best interests of the community, only wooden, post and rail, split rail fences may be installed and maintained at Cranberry Estates.

  4. There is an inconsistency in the Governing Documents regarding the maximum permissible height of fences. In addition, the Township of Perkiomen has a minimum height requirement for fences installed around a swimming pool.

  5. The Board believes that it is in the best interests of the Community to establish clear and consistent policies regarding fences which may be installed and maintained at Cranberry Estates.
NOW THEREFORE BE IT RESOLVED, that the Board adopts the following policies and standards with respect to fences:
  1. Only wooden, post and rail, split rail fences may be installed and maintained at Cranberry Estates. Fences must be maintained in their natural color. Fences may not be painted or stained. Only a clear preservative/sealant may be used on the fences. A minimum of 2, but no more than 3, horizontal rails are required. Turkey wire may be installed on the fences.

  2. Fences may not exceed a maximum height of 48 inches. When the full maximum height is not required (i.e., when there is no swimming pool), it is preferred that fences be limited to 42 inches.

  3. Unit Owners must comply with all building and zoning regulations of Perkiomen Township.
I certify that the foregoing Resolution was adopted by the Board of Directors of The Cranberry Estates Community Association at a meeting duly convened pursuant to the Bylaws of the Association on October 5, 2004.
